"Small Business Equipment Leasing Is The New Line Of Credit Financing For 2009"

Do you think apartment complexes should be sued for failure to provide services aside from maintenance?

Maybe this is an attorney general matter.
I’m in a what should be considered a nice upscale complex (though to be sure, I’ll be out when the lease is up or sooner) When I got here, not that I really cared, the little business center was shut and some gym equipment wasn’t working. Now, the gym universal is a mess making over 1/2 the equipment in the small gym not operating properly. But get this, now they’re putting up a sign that they are closing the laundry facilities permanently in 90 days.
People are paying good money to live here. This sort of thing is happening all over Florida. I don’t mean that something is down a few weeks, I mean permanently. I think it constitutes a fraud to be advertising facilities that the complexes don’t keep operating.
What’s a renter to do?
It might not be in my lease, but these things are advertised in those flashy little renter guide booklets.
I did hold onto a booklet Chatsplas.

What kind of bankruptcy options?

I am not sure what kind of BK atty to contact if any. I have a great job, make good money, and I have less than K in personal debt outside of my home. I am having to close down a small business. The problem is I have a personal guarantee on the business loan, lease, and equipment for the business. The equipment has enough equity to take care of itself, but it leaves the loan and lease. I owe roughly K on the loan, and have roughly 0K on the lease left. I don’t have any toys or extras, as my family leads a very modest lifestyle, and ultimately have fallen victims to the bad economy. The business is three years old, and we were on pace to have the business debt free within 5 years. We paid everything in advance, and now looking back was a mistake. All options to extend the debt and restructure have been exhausted. We are now going to be on the hook for almost 0K that we will never have means to pay off. I don’t know where to begin. Do I contact a business atty, a personal atty, or should I be thinking of other options. The loan is with an individual, while the lease is with a major leasing company.

Should I worry about internal network security with Apple Extreme Base Stations?

I’m thinking about installing a wireless network for a 10-unit condo complex with 2 or 3 Apple Extreme Base Stations. I’ve learned that we can enable WPA/WPA2 encryption with this equipment, but I’m worried about the network being open between neighbors (in terms of those within the complex). We have one unit that is rented out to different people on a monthly-basis, and they are given the network password.

I understand that even with passwords on each computer, some devices could be accessed and at the lease visible. Do you think this is something I should be concerned about? I’m not sure if this setup puts our computers at risk or not. If it is a concern, is there a way to make the network more secure for individuals without spending a great deal of money?

What should I do??????

Hi, okay I’m 15 and need to vent. So my mom and I were homeless and were blessed when she found this job with an apartment complex. Its not in a bad area either it is in Paradise Valley, AZ. So she took the job and we live here because she gets a discount. So at first the job was great, now she is seeing what assholes the manager and head tech are! They steal from the property, the head tech guy stole a ,000 PIECE OF EQUIPMENT!!! You know what people can do with that money? So not only is that happening, the head guy is trying to get my mom fired because hes angry that the manager didn’t hire one of the women that he recommended from his church (yeah did I mention he’s a pastor) So I am scared now even tho the manager loves my moms work and the manager gets compliments on her work from residents. So not only that but now we have a roach problem. We’ve told her multiple times and nothing. And a lot of people have complained and more people have complained about their air being broken but the other maintenance guy can’t do anything cause the head guy steals everything. And then the only people that get bonuses are the manager and the head tech of course. He also won’t buy my mom the supplies she needs and he is making her do the same apartments over again because he keeps making them dirty and so shes falling behind on her work and the manager is getting angry. My mom is looking else where now but what happens if she quits I no we have to move but will we get our deposits back or not? That was a lot of money for this piece of shit apartment. Now isn’t that wrong? I want to call the management company or even the state on their asses. Should I or should I keep my mouth shut?

Just in case your confused:
5 employees
manager
head tech
regular tech I guess
housekeeper-my mom
and leasing consultant who just sits around in the office shes fine nothing wrong with her

Thinking of opening a gym for co-workers. Need advice.?

I’ve thought a lot lately about opening a gym for my co-workers at my plant.
We have over 500 employees on site. We have no place to work out and the gyms in the immediate area are terrible and expensive.
We have checked with corperate and they will not approve any equipment for us to use.
I’ve scouted a place in a small town that is right down the road from us.

The plant is a couple of mile from anywhere and everyone pretty much has to drive through this small town.

It seems that the overhead would be low. Lease, electricity, water/ sanitation, equipment, and a security system.

The closest gym charges a month and doesn’t offer much in the wasy of amenities.

The cost of equipment isn’t a problem and the start up cost for the lease and bills won’t be hard to deal with.

(After all of that…) My questions are:
1. Is it legal to only offer membership to my co-workers and contractors in the plant?

2. Is it possible to set it up where members have a key and are responsible for unlocking and locking up As they come and go?
(We work rotating shifts and I believe people would be in and out at all hours. This is one of our problems. There are no facilities that offer 24hr. service.)

3. What type of insurance does a business like this have to carry?

4. Should it be a "social club"? And, would that circumvent the insurance and membership problem?

5. What is the best way to set up payment?

6. Does this seem to be a viable plan?

I’d like to do this as a service and really am not looking to make additional income off of it in the near future. I just want to cover the costs and do it legally. I’d like to put any money made, back into the place.
Sorry that this is so long.

Any help for a restaurant start-up?

My wife and I plan on opening a resteraunt. My wife has 10+ years as manager, baker, ordering stock, basically everything.
I my self have had similar experience, when I was younger of course, but I am a hard worker who has NEVER been turned down for a raise, I also catch on really quick to just about everything. So in a year ot two it will be possible for us to have a financial backer, so start-up money is pretty much taken care of. so to my questions…….
I would like to know things like…….
Does it really count to have some busines degree or training when looking to lease a building , or open a busines account?? (both of us have all our pre-requisites out of the way right now so it wouldn’t be hard for us to continue on, in fact I plan to)
Opening a "franchise" as opposed to starting from scratch?
Research tips on best area to open in, near malls etc.
Buying equipment…. proofers, baking racks, ovens etc.?
Tax breaks and incentives?
What ever else you think can help.

Can these people do this? Please help. ?

I am going to make this as detailed as possible. I’ve tried looking things up, but I’m just at a loss.

My mother and I recently moved to North Carolina after having years of trouble in Arizona. We have very little possessions, and simply planned on moving here with our pets and whatever we could stuff in our car.
For months my mom looked for a job, to no avail. We have very little money available, and we considered ourselves lucky when we found a low-rent "efficiency" apartment on Craigslist. The ad read as follows:

"New furnished efficiency apt with all utilities and even Direct TV, - miles to Southern Pines, Pinehurst. - minutes to Fayetteville/Sanford. No smoking indoors, no drugs. 0 plus last months rent of 450., call — before 8pm only."
(I’ve taken some information out; phone numbers and specific locations as they don’t apply to the matter.)

After months of searching, we thought we had finally found someplace to stay in the little town we wanted to live in. Of course it would only be for a few months, as the apartment was supposed to have a small kitchenette and was located in the landlady’s garage.
My mom talked to the woman renting out the apartment on the phone for almost a month before we arrived. They had the money for two weeks before our arrival, and new the date and time we would be there. Everything was supposedly set up (the beds, kitchenette, etc.), and they said it would all be ready when we got there.
After three days of driving, we came to our new home right on time at about 9PM, tired and dirty, only to find a 20 by 20 foot shed with a small bathroom and cluttered closet, filled with grooming equipment. The landlady and her husband began moving all of their stuff out of the building and putting together the beds when we arrived, as their small children ran around, jumped on the beds, and tried to feed everything they found to our dog. After being there for two hours, we could finally get some rest. We were starving, but unfortunately the kitchenette that they had been telling us about for weeks was no where to be found. My mother cried for most of the night, and woke up crying the next morning as she found that the place was even grubbier in the light.
We looked over the Craigslist ad and emails that had been sent, seeing that we had seriously been screwed over.
The situation only seemed to get worse when we realized they had lied to us about how far away we really were from town. It takes thirty minutes to get anywhere, and they had previously told us it only took seven.
The bathroom is 5 by 9 feet, and has an uncovered hot water heater, a shower "shell", a toilet, a sink that falling off the wall, and their dryer. When we leave the house, they come in and use the dryer without asking (they have a key).
There are no smoke detectors.
They never got the kitchenette. We had to buy a small dorm fridge and microwave, and we won’t even attempt to buy a stove as the room is too small. It is impossible to cook anything since there is no room, so when we get hungry we often have to drive thirty minutes to eat. This is extremely inconvenient.
Internet was supposed to be set up, but we had to do that as well. We had to buy two routers because their children broke the first one, and I had to network all the computers. I’m 16, and it’s kind of funny that every time this lady now has a problem with her computer, she comes to me. She’s also asked me to make her a website, and she even had the nerve to ask me to help her post a Craigslist ad for their old house because she didn’t know how!
They didn’t ask us to sign a lease…and now we know why.
We’ve been living here for almost three months. My mom still can’t find a job, as it is a close knit community and you need connections to get in anywhere.
They have tons of dogs (at least 16) that are always barking. They have them in cages outside, and they don’t feed/water them or clean the cages. When we walk outside we get attacked by flies and the smell of dog poop. It’s just not sanitary.
Living with a single mom can be hard, and we thought things might get better if we moved out of Phoenix since it was getting so congested. Turns out we’re in even deeper crud than before.

I honestly feel this woman manipulated the situation in such a way that she would profit from it. I think it’s truly wrong, as she knew we were coming from out of state, had no where else to stay, and couldn’t personally come and look at the apartment.

So my first question is, are they are laws that prohibit this? Can this woman post an ad on Craigslist that is selling one thing yet you get another? Are there federal laws or North Carolina state laws that require a person to have a license to rent-out an apartment? Would they even be allowed to rent this shack out?

We will hopefully we out of here by the end of August, and we were just wondering if there is anything we can do to stop this from happening again to other people, and to maybe even get back the money we had to pay to live in the awful place.
Any help or advice is appreciated. I’m sorry this ended up being so long.
Thank you.
Actually, we wanted to live in Aberdeen. My father lives there (my mother’s ex-husband), and he said it would be easy to find a job at the local hospital since my mother has 10 years experience in the field. He said it was cheaper to live here, and that we would love it.
We’d been planning for six months, and thought that we had found a decent place to live temporarily.

I know my mother messed up when she chose this place, and she realizes she did too. She feels terrible for putting us through this.

They did send pictures. Trust me, the pictures look nothing like what we ended up getting. They even sent a picture of the lake nearby, saying it was part of their property, and later told us it wasn’t when we got here.

Yes, we may sound stupid, but I think what these people are doing is wrong. They are taking advantage of an already sucky situation, and as parents they should not have knowingly rented this place to a single mother and her child.
Debra, we have called the humane society. The landlady claims to be a "groomer and breeder of dogs", when all she is doing is running a puppy mill. So many of her animals have died in just the few months that we’ve been here that I don’t even want to let her near my dog. She won’t give us a straight answer about what the humane society said when they came here.
They may not be breaking any laws renting this place to us, but they sure are doing something wrong with those dogs. Even the horses are mistreated.

Thank you all so much for your help.
Has anyone here seen that movie ‘Funny Farm’?
I feel the same way as they do in that movie. I’m surprised the mail man doesn’t throw our mail at us.

Thanks again for all of your help. And to ‘Expert Realtor’, I appreciate your answer. You live in NC, have you heard of Ellerbe? That’s where this place is. When we tell people that, they look disgusted that we live out this far (it’s pretty funny, actually).

Legal Question - default on equipment lease?

My brother sold his business including the equipment while he was still paying on the lease for the equipment. He continued paying on the lease when he hit hard times. Now he cannot make the payments and the equipment lease company is trying collect by calling him and his wife day and night and being really nasty. He doesn’t have the money right now. What are the consequences here? There is no equipment for the compnay to repossess. They probably could not recover cost of repossessing it and selling it to cover that cost and what is owed. Will they pursue that? Can my bro be criminally charged?

Is it possible to start a small bar with about $5,000-$10,000?

I want to start a small bar in MO, the location is going to be an old Wendy’s building and were going to lease it, we would only need a bartender as we would work the bar (I have a large family, so time is not an issue). We are going to lease all of the equipment needed as a security since this would be a start up business. The layout will be simple were going to do all f the work ourselves such as building the dance floor and the bar.

The building requires 00 down so we will have the rest of the money to use toward the inside… also advertising will be taking care of by the radio station.

I have seen plenty of similiar questions but they were not specific.
I have a liquor license and security is covered. Like I said before we are not going to need any outside help besides the bartender ( we have a dj, food is covered. Insurance is covered in the lease with is 0 a month (so its affordable even if all fails, also its a month to month lease as with the equipment)

Can Credit card leasing Companies report to the credit bureaus?

I signed up with a company to accept credit cards for my small business. The company I Choose to do business with totally misrepresented the amount of fees to be taken out of my account. I have since cancelled with them. However, I signed a 48 month lease with the company who provided the terminal equipment. They have now stated taking the fees out of my checking account on different days of the month which has caused my account be be overdrawn many times. I am a small business just starting and do not always have the money in my account. My question is - If I return the equipment and refuse to pay the additional terms of my lease, can they report that to the credit bureaus. I can’t afford that either.

I had a small restaurant, and on 2006 i subleased these business?

my leasing ended on march/2008 i never had any problem with the people who was running the restaurant but, they decided to do the same thing after 6 months and they sold the business on feb/2007, they ask me if they would do this and I say ok but they should still paying me the rent cause I had the commitment with the landlord and I was responsible to pay the rents so they always paid me until my leasing finished, But my guarantee was the restaurant equipment. The "new owners went into a new leasing for 5 years and it supposed they should pay me the property taxes for the furniture and equipment of 2008. But when I was paying my property taxes online I decided to check if this account correspondent to the business still under my name, unfortunateley it is and not only that, these people never paid the taxes so I did it and now they don’t want to pay me that money. What can I do if I never signed anything with them. The people who did the agreement were my buyers and now they are trying to collect this money for me but he second tenants just moved out from hte space in the middle of the night and they took out all the furniture and equipment. I have found them but it supposed that my buyers must go and ask them to pay me the money since they were the ones who sold the business and they signed the contract with this people.
What can I do?
Thank you for any help
By the way I live in San Antonio Texas.

I’m a small business owner with bad credit in need of financing. Is it possible?

I am currently leasing a suite in an office building. I have opened a nail salon and am having a hard time keeping up with the rent. I want to get some sort of financial help to purchase equipment that would allow me to rent booths to other operators, which would help me generate revenue. I need money to purchase manicuring tables and chairs. If I could just get a little help, I could really get this thing up and running, I have been told that I am very good, and being self-employed is wonderful. I am a licensed manicurist and I have big dreams of having my own franchise of nail salons. I just don’t know how I can do that when I don’t have the money already. I’m just trying to better myself and provide stable work environments for others. You can check out some of my work at http://www.myspace.com/nailit2em
