We are a family with three children 12 girl, 8 boy and just turned 1 my baby girl. Last August I came to the airport and went into labor. She was so tiny at 4 pounds. Needless to say we had to stay in a hotel in Atlanta vs the home we just had bought our first home Only after months of being in the hospital her being brought to Alabama was impossible. At 6 months wwe finally gave it back. Then we had a total of 3 time being robbed, Pictures and marriage certificate, dog bowls you name it, Even the broom looks like someone could just move in, All my children toys and special things. All my special things that have no price. Since I was buying through a owner and my mortgage payments were including the house insurance. Now after 9 months she is home for her fir\st real Thanksgiving and Christmas. My daughter fought and is a miracle. Even though on short notice we scrambled to find a house to rent (they gave me 5 days notice) the first on was in my perfect price range but it didn’t have three prong outlets for the life equipment he said they had it took our 00 and said I broke the lease. I have a very small apt in Sandy Springs near Atlanta that I wish cost as little less and had more room so I could have the ability to say to my older kids lets go to the skating rink, Six Flags, just sight see but that cost money I don’t have. They are very good loving respectful children and because of the cost of 9 pieces of equipment, the energy to run it plus only me and mickey can watch the baby or a Rn so I really don’t even have this money for Thanksgiving. Also we were supposed to go to the family for Thanksgiving with my father in law from Alabama and thought we were going to meet half way. But I don’t think that will happen, between the gas there and back 0, my share in cabin rental 0. Can you believe that we will miss my husbands father last holiday, All the family is coming all the cousins you name it.So I feel terrible not to have it for my husband his father mother and the kids, The doctors have warned us even with a hospice nurse that he would be shocked if he was still here Thanksgiving weekend, But on the kids they have lists made and it breaks my heart because I told them we could use anything in the house and give it as a gift then after church make Christmas.

She deserves it all of them dog, Because my husband had to leave his job which is no commute .He has done everything he could he does drawing and hand painting for personal children’s room turned in the the jungle or Disneyland, Ocean as store front like their store name, He worked holding the tax sign in the statue of Liberty dress, lantern and crown. Now he is picking up daily fog feces from our apt for a month but he will do anything for his family.
If you know any one in need of any type of construction, painting inside outside and like santa on the store front so your business stands out from others or having something like a mural.Or fish tank maintains he has set up, cleansing breeding them.

What can I legally do to fight back a commercial landlord who discriminately declines us an option to renew?
My family purchased a Chinese restaurant business in a commercial shopping center about five years ago in California and our five year lease is up in August. The owner of the commercial property has not offered our restaurant business an option to renew our lease. We had already invested a couple of hundred thousand dollars in this business (including expensive computer and kitchen equipment), but as the end of the lease approaches, we’re scared that we can’t even sell the restaurant off even if we wanted to. I have spoken with the Asset Manager of the company that owns the property and he said that he cannot give us a long-term lease but we can pay rent on a month-to-month basis.
When I asked why couldn’t we get a long-term lease renewal, he originally said that they were going to do some remodeling on the entire front building complex (the building’s arcade) after our lease ends sometime while we’re paying rent on a month-to-month basis and then he said that we will need to vacate the premises once construction actually starts (he also said that he was going to give us a 30-day notice to vacate as well). But then I asked if we could get our original business location back after construction has completed… A moment later he said that there’s going to be a "70% chance that there’s going to be investment in the property" so that they can "change up the assortment of tenants on the property" towards a specific marketing concept where there will be select requirements for the new tenants: business income level, type of business, ability to pay higher rent, etc. I don’t exactly know what kind of "marketing concept" he was going for or even if restaurants were a part of that marketing concept equation’s composition.
It’s interesting to note that some of our family business’ neighboring tenants are also of Asian-descent, but they have about two years of their lease left. I just found it odd that they were targeting our mom and pop businesses and slowly try to get us out of the shopping center.
Can this company just kick us out like that? Isn’t there some sort of California Commercial Code that says this illegal? But more specifically (and what my family’s more concerned about), is there any way to make the company help us recoup our losses from having to find another location for our restaurant business?

Is this criminal? What should I do?
Landlord and myself came to a mutual agreement for us to move out and void the lease. We were in Nevada travelling home at the time. I told them not to go inside our house and that we would start moving out as soon as we got there. We found a Dispossessory notice stuck to our door when we got home. It was already past the date for us to answer. We never recieved the Writ of Possession. My dad died that weekend. My husband went by our place to get a picture of my dad on the day of the funeral. He finds the landlord’s maintence guy boxing up our stuff. So he calls the landlord. She said don’t worry they’ll put it in storage and to go be with our family. Had yet to see a Writ of Possession. A week later when we asked to get our stuff our landlord would not tell us where it was and that we had to pay almost 00 to get it back. They claimed that was their moving fee. They never told us this while they were moving our stuff. We have very expensive computers, furniture with a big screen TV, music equipment, and important documents including military records and my EMT license inside. Also an expensive mattress for a customer we were supposed to deliver in Florida. They have moved it to a different county according to them. They will not let us in to get the documents we need for employment and the mattress. We also have home movies and pictures of my son’s birth and my dad that can never be replaced. This was in March. We have been asking them since then for access and one minute they say okay. The next day they refuse. They did not have any law enforcement there to monitor or do the move. Just them. They’ve threatened to sell our stuff. Total value is between ,000 and ,000. What can we do? We have nothing. Very few clothes also. Our son’s toys are in there too.

Apartment removing perks/amenities - is there any legal recourse?
I’m renting a supposedly ‘luxury’ apartment (cough). Paying 00 a month for a one bedroom not including any utilities even water, sewer or trash. The apartment was supposed to have a computer room and a game room.. The apartment has only been open about two years and already they’ve taken the pool sticks/pool balls/shuffleboard equipment, etc. from the game room.. Removed 1 of the 4 computers, removed the printer from the computer room, and the internet has not been ‘live’ in the computer room for over a week. Apparently SOME tenants were taking advantage/messing things up, but they have cameras in the public areas and I don’t believe all responsible tenants should be punished! Is there any legal recourse or do tenants have no right to request the return of perks advertised and available when signing the lease. This is in Virginia in Loudoun County. Oh yeah.. and the gate clickers for the parking garage don’t work every month or so.. but I’m not even going to complain about that. I just feel taken advantage of in general because it seems they just keep taking stuff away and I’m already paying an arm and a leg for the SUPPOSED ‘luxury’.
Just to clarify: I’m not trying to sue the apartment or anything.. It’s just annoying that they advertise these things as perks/amenities and then slowly take things away one by one.
I do need to have a look at the lease.
I’m just wondering if I have a right to complain or if I’m in the wrong at getting annoyed by these things.
Yes, I can afford a computer/internet, but it’s nice to be able to go into the business center/meeting room and take my laptop there to ‘escape’ for a little while. No need to be a smart-a**.
I also don’t like being punished, and having all other RESPONSIBLE tenants punished for the actions of a few unsupervised little brats/low-lives/drunkards/whatever who decided to break pool sticks or throw pool balls.. The security cameras are there for a reason and I believe the landlord/managment should have seen who did it and punished them vs. punishing everyone.

Isn't it pointless to BUY electronic equipment, such as computers or cellphones, if they?
are going to be considered NO GOOD, OBSOLETE, or YESTERDAY’S NEWS the very next year?
It’s like, i people are going to be like "Oh, that is SO last year", then why BUY it and waste your money?
Wouldn’t it be better just to LEASE them or RENT them out one year at a ime or something?
Wouldn’t that make more sense than BUYING them with the intent of keeping for the next 5 years or longer??
BTW, when are cellular phones going to start having chargers with recessed fittings?
The main reason why cordless house phones rarely had a problem with low battery life was because people just set them down on the recessed fitting to recharge, there was no effort involved, no hassle of picking up a cord and sticking the prong end into the phone, but since cellular phones have that problem, that’s why they don’t get recharged as much as that’s why peoples’ cellular phones shut down on their own when they’re out and about, and that’s why it’s only desirable to go through the trouble of dealing with the cord and prong of recharging it when it NEEDS it, otherwise, it feels like an unnecessary chore.

My business partner and I just acquired a small cafe that were going to be transforming into a Deli/cafe type business. My question is about commercial refrigeration, now ive heard a lot about leasing the equipment at least at the beginning but have only found one company that does it Central Restaurant .com or something like that. but i would like to compare pricing
What are your guy’s thoughts on going with a lease option at least at the beginning?

If I rent out one bedroom in my house (Texas), is the following legal: (details inside)?
All these things would be in the lease:
Rent it by the week.
Get 4 weeks rent in advance. (Call it a security deposit if that makes it legal, it is the amount that counts here.)
Get rent a week in advance.
Have a composting toilet system in the house instead of a flush toilet.
No overnight guests.
Tenant cannot install window unit AC in their room. Temperature in the house will always be around 80 degrees Fahrenheit in warm parts of the year, and near 70 in winter.
Tenant cannot use surge protector strips or similar item for anything but computer-related equipment.
Tenant cannot have refrigerator in their room. A shelf will be provided for them in the kitchen refrigerator, as well as a small space in the freezer.
Start eviction process two days after they miss rent the first time.
I forgot to add:
I reserve the right to inspect the tenants room at any time.
Tenant cannot change lock or doorknob, or add any additional locks.
Landlord, a prisoner wouldn’t have a choice of whether or not to sign a lease. Obviously, they are a free person. The question here is, am *I* free to make these rules or not.
And I haven’t read anything yet in any regulations about flush toilets. Can you please post a link to the rule about flush toilets? I am not saying that you are wrong about that, I just want to see it in writing, that’s all.

Landlord, the room they are renting is MY private property, and that is what I would be inspecting. I wouldn’t be rifling through their belongings.

Tax advice needed for partnership restaurant?
I am the bookkeeper for my friends who own a restaurant. They are husband and wife, in Virginia, opened for business in January 2010. I have several questions …
1. They lease/rent the building and most of the equipment. They pay ,000 month for "rent" and ,000 "lease liability". In Quickbooks I have it set up at rent expense for ,000 and then the lease as a fixed asset, so the lease liability ,000 comes off that. How do I account for the lease liability and that ,000 on the Form 1065?
2. The building has an upstairs which at one time was a small lounge/bar area for a previous restaurant. This couple remodeled the upstairs and made it into an apartment so they could live there and rent their personal home. I am accounting for the remodel costs as leasehold improvements, is this correct? Also, how do I then account for the leasehold improvements on the form 1065? I know I also have to separate expenses now for business versus personal use of the space and utilities. I also have to base it on the percentage of the year since they didn’t start using the personal space until July of 2010.
3. The business gross sales after returns and allowances was 2,000, so should I use materials and supplies expense instead of cost of goods sold, or am I better off to use the cost of goods sold since I expect their income for 2011 and beyond to exceed 0,000?
4. Depreciation (sigh) … The owners do not get a salary or guaranteed payment, and the business had a net loss of ,000 for 2010 (without figuring depreciation into that loss amount). Should I use Section 179 and carry it forward into the following years, or should I use a different depreciation?
I know this is a lot to ask and I may not have given enough info to answer all questions thoroughly, but any help is greatly appreciated!

1. So, I am depreciating the building / equipment as if it were purchased, even though it is only leased, is this correct? Is there a certain depreciation method I should use for this?
2. Why can’t I use leasehold improvements for the changes they made since they are permanent changes that will remain with the building (They added walls to make rooms and added a personal bathroom, with shower, tub, etc.) even if my friends don’t end up buying the property when the lease is up? I know they made these changes for their own personal reasons, but they do add value and change the purpose of that part of the property … in the future, it can be rented out as an apartment.

common area maintenance fee - after getting out from the business.?
My parents had a small shop, and the business was doing so bad that they had to leave the place. They agreed to give all the equipments and stuffs so that the landlord can lease the place again. The landlord understood the situation and decided not charge for the back rents. My parents got out of the business losing everything on May, and the place has been leased after six months (November).
We recently got a letter from the landlord, that we are still liable to pay Common Area Maintenance Fee, until the place got re-leased.
Are we really liable to pay it?

Buying a business and hiring the owner a bad idea?
I own and operate a small bakery. I have 5 full time employees and 1 part time employee. 2010 sales just over 0,000 and profits are in low 20%. Not horrible, but not great. I have the chance to buy out a competitor. Sales around 0,000. Profits are around 15%.
One of the conditions of the sale is I take over the lease of his company, which expires in 4 months. He owns about ,000 worth of good equipment, but he owes about ,000 on it. He wants me to give him and his employee employment at the rate of .25 per hour for these 4 months. If I fire them, I get stuck with unemployment. I don’t need these two. I want the equipment. I want the competition to disappear. My wife says he will go out of business, I can buy the equipment at auction. If somehow he hangs in and grabs say ,000 worth of the wedding cake business this spring, that’s money I can’t grab. I’d say there is about ,000 worth of wedding cakes sold April, May and June in this market. I personally grab ,000 or so. It is important to me, just not important enough to get stuck with him and eventual unemployment.

verbal contract, serious question?
ok, my mother ad step father owned a restaurant, after poorly managing it they were forced to close it down about two years ago, they tried unsuccesfully to sell it, so they leased it to a couple in dec of 2009. they had a year lease, which stated that either party could terminate the lease with ninety days written notice, well the people stayed six months and just left, taking with them some of the equipment and small wares, so they sued them for breaking the lease. this in turn also left them in a bind because they had a loan on the place and had no income from the people leasing it. I decided to take it over in july of last year, i took out a small loan of 00 to cover start up costs. we agreed upon the terms, they showed me the lease that the previous people had signed and i agreed to the lease with the exception of the difference of the lease amount. they told me they would type up a new contract.. well they never did it. so last month we had a disagreement over what day the lease payment was due, they had initialy told me the 1st and then were trying now to say the 27th, whatever no big deal, so again i was told when he (my step father) got home we where going to do up a lease ( he works on the river gone 30 days at a time) i said thats fine. in the mean time its been 8 months, ive built up a business, since the discussion of the lease last month i just ran a bunch of advertisement that cost me a few hundred dollars, and of course bought food and other items needed to keep the business running. well two days ago he calls me and informs me that he is selling the restaurant and i have two weeks to get out. I am just beside myself, not only do i have the remainder of the loan which i took out, i have about 00 worth of food an dinventory that i have no way to get rid of, plus they are taking away my lively hood, i am a single mother of four and this was my only income. now im not stupid, i realize i can not force them not to sell, but do i have any recourse since i was only give two weeks, ( and mind you we are only open 4 days a week)
the termination clause in the old lease stated that either party could terminate the lease with 90 days written notice.
well unfortunately there is no where else to open, and our little town could not support another restaurant,there was another one here and i have almost put them completely out of business. the bad thing is they are telling people that there is "new management" taking over, inferring that my business was sold instead of that they bought the building and equipment,

Advice On Buying VS. Renting with financial factors?
I am a 19 y/o male. I am also a small-medium size business owner. I was renting an apartment with a friend for a year and was an easy 0/month rent. At the end of the lease, I moved back home with my parents until I am able to differentiate between the pro’s and con’s of renting and buying.
My personal budget has mostly fixed expenses and slightly variable expenses, this includes putting 5/month into savings.
I am differentiating between a 1,000 sq ft newer apt which also has a pool and gym at the clubhouse (/mo savings) and a 1,000 sq. ft home which may need a few updating repairs.
The financial advise I need…. if I rent, after savings and expenses each month I will have about 0 left over in checking… If I buy first, I will have about 0 left over each month in the checking. These are mostly worst case scenarios with expenses estimated higher.
I am considering renting for a year or two so I don’t have the financial stress of "what if" so much and to gain a cushion in my checking account, and to feel a bit more security and not living paycheck to paycheck.
Another factor, if I buy (0,000 house on an acre) I plan to stay there about 3 years and move up to about a 0k-5k house as my salary increases, so there are closing costs to factor in for only 2-3 years.
My con of renting is, can’t make changes, can’t add a garage and rent it out to my business (tax deduction, greater personal income, and all business equipment is easily accessible, and kept out of weather)

Looking to go thru Swift's CDL Training Academy, probably the one in TN..What to expect?
Does each student get their own room or do u gotta share a room and or beds with other students?

f you went thru this academy before, is there any good diners, restaurants within walking distance from the motel? Is there a Wal-Mart or K-Mart, Target etc in walking distance?
Does the motel provide like any free breakfast or anything each day or do we all chip in to buy food?
I heard from a friend I can no longer contact cuz I lost his phone number who recently went thru Swift in their academy right outside Memphis, ( Millington, TN ) I believe it’s called..He told me once u ride with ur mentor/trainer now that u do not have to stay with ur mentor for the required weeks anymore before being assigned your own truck, but now u have to just get a certain amount of miles under your belt before u can get ur own truck?
Also he told me u cant run anything electronic in ur truck unless there is a factory hook up for power for say like a TV, and if u wanna power anything else u gotta use the cigarette lighter plugs to power things and that u are NOT allowed to use any kind of power converter ( I have a 100 watt once, enough to charge a cell phone and run my laptop..) Is it true you cannot use any sort of power inverter ? So I am told u sort of can but when u go into a terminal or get service down on ur truck u MUST somehow hide it…If they find it they are allowed to take it away from you..(This is what my old friend told me)
ANY MORE Details about works for, training for, swifts equipment, if I cant get along with my mentor while I am on the road can I request another one?
Can I request to go with a mentor that uses a company owned truck rather then someone who is trying to lease purchase a truck?

Has anyone heard rumors or facts about Swift maybe turning up the trucks? Or must you be in a Lease Purchase agreement in order to do this? Do they only have 9 speed trucks or 10 also, and are they bringing in or does anyone here have a Swift company tractor with a Auto Shift transmission?

How can a student get a loan to start a small espresso cart operation?
I’m currently 21 years old, a full time sophomore in a community college and planning on attending a state university in fall of 2011 as a junior. My guess is that I have around 2.5 years of school ahead of me until I get my bachelor in some liberal arts major. Currently, I’m undecided in what I will major in, but right now I’m just getting general studies out of the way. I imagine that I will end up majoring into either Philosophy or Psychology, or something withing writing. None of the majors I am interested are likely to get me hired in a high paying position or a sustainable one.
I’m currently working ~30 hours a week in a coffee shop. I’m really tired of working for people (I have been working in food service for around five years now.) I really want to get out working minimum wage- .00/hour being a slave to customers and business owners. I’d like to start making my own money, and considering I do have the intelligence and expertise within coffee, I figure that I could create my own income.
Small espresso stands seem like a very affordable, low risk, high profit yielding operation. If I bought used equipment (with plenty of research) I think I could buy the entire stand for ~8,000 dollars (don’t quote me, I’ve just begun researching.) I’ve maintained and operated espresso machines, I know local roasters from previous jobs who could give me a deal (one guy lets his customers use his coffee grinders/pots for free as long as you buy his beans.) My step dad has his own solar electric equipment and he could try to rig up some panels to make it an efficient cart.
So… I feel like I have plenty of ideas on how I could potentially put it together. Place the cart by big sporting events, festivals, holiday events, etc etc. I live by a very large university so it wouldn’t be difficult to find events.
My limitations would be as follows:
I have a small car that I would not be able to transport the cart in. I would have to buy/lease a truck or trailer to move the equipment and I’m not sure how I could move it easily without help.
I have hardly any money saved. I may be able to pull together ,000 of my own money, but I doubt much more than that.
I have no real credit established. I have ,500 of credit debt but no student loans. I could pay off all the credit this spring if needed.
Questions:
Would it be possible to get a private loan to start the operation? Or could I get a student loan and use the money to buy all the equipment with plans to pay it all back?
I could work another job part time if needed while I get everything going to have some source of income.
If I can’t get a loan I could possibly loan some money from my parents (~4,000 max), but I’m not sure if that is even feasible.
Any suggestions would be helpful. I really feel like I could profit off of doing this. I know the bizz, I’m an excellent barista, and I’m motivated to work for myself.

Larger downpayment or more profitable?
We leased a small business last year and generated about 0,000 in revenues. We also had about 7,000 in expenses. Much of the expenses was due to us buying new equipment, all of them one-time purchases. Otherwise, we would not have to report a loss. We need to go to a bank and make a loan to officially buy the business from the owner next February at the end of our two-year contract. My question is this: is it better to have a larger downpayment — say, half — or show a small profit the first year by not claiming all of the expenses on our federal taxes? If we write off all of our expenses we will have much more money to put toward the downpayment but the bank will see we operated at a loss. Won’t the bank realize most of the expenses were one-time, startup costs? We have no collateral to speak of so we are going to have to rely on a downpayment and credit, I guess. This year, our second year in business, we will not have the one-time, startup expenses and we should show a profit and no loss on our taxes. Won’t the bank take that into consideration?

If there is a salvage value of $1,000? There is more?
Efren is considering buying some new equipment for his restaurant for ,000. However,
the restaurant supply store says they also lease equipment. The supply store will offer him
a five-year lease with no down payment, four annual lease payments of ,000 per year,
and a final payment of ,000. If Efren’s cost of capital is 8%, should he select the lease
or purchase option? If there is a salvage value of ,000 if he buys the equipment but no
salvage value with the lease option, will his decision change?

Since we have been learning a lot offormulass ( and im not good even ok at excel) I don’t know what I was supposed to do to figure this one out. Formula that is. i’m just a small (very) business and need health insurance?
i work for myself and can only afford one part-time employee. i don’t have any health insurance as i can’t afford it. i have taxes to pay, single dad who’s supposed to get child support (but the mother hasn’t paid in two years), i have to pay for workers comp insurance plus business bonding/insurance, i pay child support for another child that doesn’t live with me, i have the business vehicle payment plus insurance, equipment payments, place of business (lease payment), and basically all the other overhead that comes with the business which is my only source of income.
i don’t have an employer to get health insurance from according to obama’s plan so mccain’s credit of 5k so i can go get my own policy obviously is attractive to me.
which candidate’s plan better suits me here?
note:the workers comp is required for the contracts i work for as i am generally a sub-contractor

Help with a Batch File I wrote…?
First I want to make a few things clear about the situation.
The script is solely my property, it has not assumed ownership through contract.
I do contract work for a vendor for the government distibuting and installing computer leased equipment. I’m in my 20’s, and I wrote a batch file that does my job for me. I am supposed to do windows updates, antivirus updates, and a few proprietary software installs, but everything is accessable relative to my job, from within this one console.
So anyway, the vendor tried to steal it from me, and now I wish to incorporate some way to license it per use, but I have no idea how. Since they want it so bad, I wish to sell it to them (since I don’t directly work for them). Their techs were taking 2+ hours for the same work I am doing in 20 minutes, because I don’t have to download anything, everything is localized to removable media (or local network accessible). I am also interested in copyrighting the software, but don’t know how to; I never expected the code to become such a useful utility and becomming standard issue….
The code is internally tagged with remarks, stating that it was created during personal time, and displays my business name and site, since I do have my own (home) business.
Any help is appreciated!

Need insight on what to do with mold in basement?
I moved into a place and my ll knew my daughter would have her bedroom there so he painted and there is water damage and ther is mold growing up the wall along with spore like looking things from the ocean and the carpets in 1 corner stay wet and he has not bothered to clean them and he told me to clean the walls with clorox bleach is that not his responsibility? I have since had my daughter sleeping on the couch due to the mold and I was going to move her in a bedroom upstairs with my 4 year old but was told her mattress along with her clothes and all her computer equipment could as well have mold particles that spread through the air, do i need to get rid of her bed and her clothes? I have already had to throw out a dresser because it was in that corner is this safe the heating and cooling unit is in the basement is this spreading throughout our townhouse? would I be wrong to break my lease and move I have a 11 yr old and a 4 yr old that couch all the time and I am worried for both their health and mine I also feel her should replace the items I may have to get rid of I have searched the internet and cannot find anything that tells me what to keep and what to keep My ll has know about this for over a month and it keeps getting worse. Please ehlp me any insight or personal experiences?

I will not disclose developments covered by this Section D to any person outside the Company unless I am requested to do so by management personnel of the Company. Do you think apartment complexes should be sued for failure to provide services aside from maintenance?
Maybe this is an attorney general matter.
I’m in a what should be considered a nice upscale complex (though to be sure, I’ll be out when the lease is up or sooner) When I got here, not that I really cared, the little business center was shut and some gym equipment wasn’t working. Now, the gym universal is a mess making over 1/2 the equipment in the small gym not operating properly. But get this, now they’re putting up a sign that they are closing the laundry facilities permanently in 90 days.
People are paying good money to live here. This sort of thing is happening all over Florida. I don’t mean that something is down a few weeks, I mean permanently. I think it constitutes a fraud to be advertising facilities that the complexes don’t keep operating.
What’s a renter to do?
It might not be in my lease, but these things are advertised in those flashy little renter guide booklets.
